Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and John M. Roberts Renovations ("Company," "we," "us," or "our") regarding your use of our website and services.

Quotations and estimates provided by us are valid for 30 days from the date of issue unless otherwise specified. Estimates are based on information provided by the client and site assessment at the time of quotation.

Final pricing may be subject to adjustment if:

  • Project scope changes are requested
  • Unforeseen structural or technical issues are discovered
  • Material costs change significantly
  • Additional work is required for code compliance
  • Client-caused delays extend the project timeline

Any price adjustments will be communicated and approved before proceeding with affected work.

Payment Terms

Payment terms will be specified in individual project contracts. Typical payment structure includes:

  • Deposit: Initial payment required to schedule project and order materials
  • Progress Payments: Payments at defined project milestones
  • Final Payment: Due upon project completion and client approval

Payments must be made according to the agreed schedule. Delays in payment may result in work stoppage until payment is received. Late payments may incur additional fees as specified in the service agreement.

Client Responsibilities

As our client, you agree to:

  • Provide accurate information about the property and project requirements
  • Ensure legal ownership or authorization to perform renovation work on the property
  • Provide access to the property as needed for work and site visits
  • Make timely decisions regarding design choices, materials, and project elements
  • Ensure the work area is accessible and clear of personal belongings
  • Maintain adequate insurance on the property
  • Comply with payment terms as outlined in the service agreement
  • Communicate any concerns or issues promptly

Warranties and Guarantees

Workmanship Warranty

We provide a warranty on our workmanship for a period specified in your service agreement (typically one year from project completion). This warranty covers defects in our work under normal use conditions.

The warranty does not cover:

  • Normal wear and tear
  • Damage caused by client misuse or neglect
  • Modifications or repairs performed by others
  • Acts of nature or force majeure events
  • Issues arising from failure to maintain as recommended

Material Warranties

Materials and products carry manufacturer warranties. We will assist you in understanding and utilizing these warranties but are not responsible for manufacturer defects or warranty fulfillment by third parties.

Changes and Modifications

Requests to change project scope, design, or materials must be submitted in writing. We will provide revised pricing and timeline estimates for approval before implementing changes.

Changes may affect project cost, timeline, and warranty terms. Significant changes may require a revised contract or addendum.

Project Delays

We strive to complete projects according to agreed timelines. However, delays may occur due to:

  • Weather conditions affecting construction
  • Permit or inspection delays
  • Unforeseen structural or technical issues
  • Material delivery delays
  • Client-requested changes or delays in decision-making
  • Force majeure events

We will communicate promptly about any delays and work to minimize their impact. Timeline extensions due to circumstances beyond our control do not constitute breach of contract.

Cancellation and Termination

Client Cancellation

You may cancel a project by providing written notice. Cancellation terms will be outlined in your service agreement and typically include:

  • Reimbursement for work completed to date
  • Payment for materials ordered or delivered
  • Administrative fees for project setup and planning
  • Costs for subcontractors already engaged

Company Termination

We reserve the right to terminate a service agreement if:

  • Client fails to make payments according to agreed terms
  • Client breaches material terms of the agreement
  • Work conditions become unsafe
  • Client conduct is abusive or threatening to our team

Liability and Indemnification

Our liability is limited to the total value of the service agreement for the specific project. We maintain appropriate insurance coverage for our operations.

We are not liable for:

  • Pre-existing conditions or defects not disclosed or discoverable during initial assessment
  • Damage to hidden or inaccessible building elements beyond reasonable detection
  • Client property not removed from work areas despite our requests
  • Indirect, consequential, or incidental damages

Clients agree to indemnify us against claims arising from undisclosed property conditions, lack of proper ownership authorization, or client-caused issues.

Dispute Resolution

In the event of a dispute, parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, parties may pursue mediation before resorting to legal action.

These Terms and any disputes shall be governed by the laws of Romania. Any legal proceedings shall be conducted in the courts of București, Romania.

Intellectual Property

All designs, plans, and creative work produced by us remain our intellectual property unless ownership is explicitly transferred in writing. Clients receive a license to use designs for their specific project.

Our website content, including text, graphics, logos, and images, is protected by copyright and trademark laws. Unauthorized use is prohibited.

Website Use

Our website is provided for informational purposes. You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to website systems
  • Introduce viruses or malicious code
  • Scrape or harvest data without permission
  • Impersonate others or provide false information
